This Data Processing Agreement (“Agreement“) outlines the commitments of TMAKER regarding the processing of personal data for users of Feather (hosted on Feather.so).

Introduction

TMAKER is committed to protecting the privacy and security of personal data. This Agreement details how we process personal data in compliance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, GDPR).

Definitions

  • Company Personal Data: Any personal data processed by TMAKER on behalf of users.
  • Data Protection Laws: EU Data Protection Laws and, to the extent applicable, the data protection or privacy laws of any other country.
  • GDPR: EU General Data Protection Regulation 2016/679.
  • Services: The blog hosting platform services provided by Feather, allowing users to create their blog while having their content written on Notion.
  • Subprocessor: Any third party appointed by TMAKER to process personal data on behalf of the Company.

Our Commitments

1. Compliance with Data Protection Laws

TMAKER complies with all applicable Data Protection Laws in the processing of personal data.

2. Data Processing

We process personal data only as necessary to provide our Services and in accordance with user instructions.

3. Personnel Confidentiality

We ensure that our employees, agents, and contractors who have access to personal data are bound by confidentiality obligations and have undergone appropriate training in data protection.

4. Security Measures

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including:
  • Encryption of personal data.
  • Measures to ensure the ongoing confidentiality, integrity, availability, and resilience of processing systems and services.
  • Regular testing, assessment, and evaluation of the effectiveness of technical and organizational measures for ensuring the security of processing.

5. Subprocessors

We use the following subprocessors to assist in providing our Services:
  • crisp.chat
We ensure that subprocessors are bound by data protection obligations consistent with our commitments.

6. Data Subject Rights

We assist users in exercising their rights under the GDPR, including:
  • The right to access personal data.
  • The right to rectify inaccurate personal data.
  • The right to erase personal data.
  • The right to restrict processing.
  • The right to data portability.
  • The right to object to processing.

7. Personal Data Breach

In the event of a personal data breach, we will notify affected users without undue delay and provide sufficient information to allow users to meet any obligations to report or inform data subjects under Data Protection Laws.

8. Data Protection Impact Assessments

We provide reasonable assistance to users with any data protection impact assessments and prior consultations with Supervisory Authorities or other competent data privacy authorities.

9. Data Retention and Deletion

We retain personal data only as long as necessary to provide our Services. Upon termination of the Services, we will delete personal data within 10 business days, unless otherwise required by law.

10. Data Transfers

We may transfer personal data outside the EU and/or the European Economic Area (EEA) while ensuring that appropriate safeguards are in place.

11. Confidentiality

We keep this Agreement and any information received about users and their business confidential and do not disclose such information without prior written consent, except as required by law.

12. Notices

All notices and communications must be in writing and delivered personally, sent by post, or sent by email to support@feather.so.

13. Governing Law and Jurisdiction

This Agreement is governed by the laws of France. Any dispute arising in connection with this Agreement will be submitted to the exclusive jurisdiction of the courts of France.
